Must I take the stormwater (rainwater) form my neighbour?
Yes, you are by Law, if you are lower lying in level / height, take / accommodate the rainwater from your neighbour.
Can I close the holes in a boundary wall between my erf and my neighbour?
No, you are by Law, if you are lower lying in level / height, take / accommodate the rainwater from your neighbour.
Can I discharge rainwater from my house gutters into the sewer system?
No, all rainwater must be discharged on the surface or in stormwater systems. The City’s sewer system is not designed for storm-/ rainwater, and this extra water will case the sewer to overflow.
How should the backwash water of my pool and / or condensation water from air conditioners be handled?
Pool backwash water and air conditioner condensation water should be discharged into the sewer system
What is allowed on sidewalks?
Boulders (big rocks) or any other obstructions, except bollards and trees as specified in the Application for Trees or Bollards on the sidewalk, are not allowed. Flower boxes need to be at least 1 meter from the road edge with a maximum height of 150mm.
Can I pave the sidewalk in front of my erf?
Yes, but as specified in the Application for Trees or Bollards on the sidewalk, and for the cost of the Erf-owner.
My Erf is higher / lower than the sidewalk level. Can I change the level of the sidewalk to be able to access my erf?
No, the sidewalk levels may not be changed as Municipal services are located underneath the sidewalk and can be damaged. It is the responsibility of the Erf owner to plan his development in such a way not to change the sidewalk levels. No support walls for accesses are allowed on the sidewalk. The minimum distance for garages is 5m from the road edge, if the garage door faces the street.
May I offload and / or store building material / building rubble on the sidewalk?
It is allowed, but building material should be neatly placed at least 1 meter from the road edge, to allow for safe pedestrian movement. Building rubble must be removed within 10 days of being placed on the sidewalk. Non-adherence may lead to prosecution.
May I demarcate / fence off a portion of the sidewalk for building purposes?
Only if the erf is in the Central Business District or Industrial Area. The Erf Owner should apply at the Section Engineer: Maintenance, Tel No 290 2443. The safety of the pedestrians and road users is taken into account in approval of the application. A refundable ‘Hoarding Deposit’ will be determined and required before the demarcation is done. An inspection is required once the sidewalk is reinstated, where after the deposit will be refunded if the sidewalk is reinstated to its original condition.
